Overview
The Market Inquiry Division conducts in-depth inquiries into the state of competition in markets where structural or behavioural features may hinder competition. The Principal Legal Counsel will lead legal and analytical work in market inquiries, ensuring investigations are legally sound and aligned with the objectives of the Competition Act. Responsibilities include resource allocation, participation in Commission Committees, and capacity building for research and report writing.
Requirements
- A completed Bachelor of Laws Degree or equivalent qualification.
- A Master’s Degree in Law will be an added advantage.
- 8 – 10 years’ experience, with at least 3 years in management or strategic leadership.
- Demonstrated litigation experience (civil and/or commercial).
- Good knowledge and understanding of Common Law and Court proceedings.
- Experience in Competition Law and market regulation.
- Strong drafting, analytical, negotiation and litigation skills.
- Proven research and investigative skills including evidence-based analysis.
- Experience leading multi-disciplinary teams and managing complex investigations.
Responsibilities
- Provide legal support to the Market Inquiry Division.
- Lead and manage the legal and technical dimensions of market inquiry investigations.
- Guide scope definition, issue identification, and development of legal-analytical frameworks.
- Conceptualise and develop analytical frameworks for market inquiries.
- Provide day-to-day guidance to the technical team.
- Lead the development of information requests and evidence-gathering protocols.
- Manage, supervise, and evaluate the performance of a multi-disciplinary team.
- Interpret and apply competition legislation.
- Draft and review inquiry reports.
- Formulate potential remedies for competition distortions.
- Monitor compliance with recommendations and remedial actions.
- Lead stakeholder engagements and manage external legal counsel.
- Provide litigation support for market inquiries.
